This Policy describes how Individual Entrepreneur Tereshchuk Andrii Oleksandrovych (hereinafter — the Registrar), who provides services through the Site UATLD.COM, processes personal data. The document is an annex to the Public Offer and is developed in accordance with the Law of Ukraine «On Personal Data Protection» No. 2297-VI of 01.06.2010, the Law of Ukraine «On Electronic Commerce», the regulations of the administrators of domain zones and the requirements of ICANN, as well as the EU General Data Protection Regulation (GDPR, Regulation 2016/679) — with respect to the data of EU residents.
Within the relations under the Agreement, two categories of personal data are distinguished:
Regarding the Partner: name or full personal name; EDRPOU/RNTRC code or a non-resident’s registration number; address; contact details; data on orders and payment confirmations (without full payment card details). Regarding Registrants (transmitted by the Partner): surname, name, patronymic or name; postal address; telephone; e-mail address; where necessary — the details of an identity document, in the cases provided for by the registries’ regulations (transfer, change of Registrant). Technical data (IP address, browser data, operation logs, cookies) are collected automatically.
The legal bases for processing are the consent of the data subject, the performance of a contract to which the subject (Partner) is a party, and the fulfilment of obligations provided for by the legislation and the registries’ regulations. The purpose of processing: provision of the Services and the functioning of domain names; identification of the Partner; compliance with the requirements of the registries and ICANN; publication of contact data in the WHOIS and RDAP services in accordance with the regulations (taking into account the possibility of anonymisation); issuing invoices and financial accounting; service notifications; dispute resolution and compliance with the requirements of the legislation. Processing is limited to the data necessary for the said purpose; automated decision-making producing legal consequences is not carried out.
Personal data may be transferred to: registries, registry operators and ICANN — as a condition of the registration and maintenance of domain names; the WHOIS and RDAP services — in accordance with the regulations; payment providers — for processing payments; a court or an organisation for the resolution of domain disputes (in particular the WIPO Center) — in accordance with the UA-DRP/UDRP; law enforcement and other authorised bodies — upon a lawful request. Some of the recipients and servers are located outside Ukraine, therefore such transfer is cross-border and is carried out with an appropriate level of data protection ensured. The cross-border transfer of the Partner’s data is ensured by the Registrar on the basis of the Partner’s consent; the cross-border transfer of Registrants’ data is ensured by the Partner as their controller on the basis of consent obtained from the Registrants. The Registrar does not sell personal data and does not transfer them for other purposes without legal grounds.
The data are stored in the Registrar’s billing system and on the servers of engaged technical contractors; the servers may be located in Ukraine or outside it (in particular in the EU). The Site operates via the Cloudflare Inc. (USA) network, through which part of the network traffic (including IP addresses) passes through its infrastructure. Up-to-date information about the location of the data is provided upon request.
Personal data are processed throughout the term of the Agreement and the delegation period of the corresponding domain names, and after termination — for the periods determined by the registries’ regulations to ensure the uninterrupted functioning of domain names and the identification of Registrants, and for the periods established by the legislation for financial accounting.
A personal data subject has the right to: know about the sources of collection and the location of its data and the purpose of their processing; receive information about the conditions for granting access to the data; access its data; receive a response as to whether its data are being processed; make a demand for the modification, correction or destruction of its data if they are being processed unlawfully or are inaccurate; protection against processing that violates its rights; withdraw the consent granted; lodge complaints regarding the processing of its personal data with the Ukrainian Parliament Commissioner for Human Rights or with a court. For EU residents, the rights under the GDPR additionally apply, in particular the right to restriction of processing and the right to data portability. The Partner’s rights are exercised by contacting the Registrar. The Registrants’ rights are exercised through the Partner as the controller of their data; the Registrar as the processor assists the Partner in fulfilling the corresponding requests within the limits of its functions.
The Registrar takes technical and organisational measures to protect the data against unauthorised access, loss and destruction; the data are transmitted using the secure HTTPS/TLS protocol. The Site uses cookies and similar technologies for functioning and analytics; by continuing to use the Site, the user agrees to their use.
Requests regarding personal data are sent to the Registrar at the contacts indicated on the Site https://uatld.com. The person responsible for the processing of personal data is Individual Entrepreneur Tereshchuk Andrii Oleksandrovych.
