This document is an annex to the Public Offer of Individual Entrepreneur Tereshchuk Andrii Oleksandrovych (hereinafter — the Registrar) and describes the procedure for performing the main domain name operations that the Partner carries out through the personal account and (where available) the interaction interface (API/EPP) on the Site UATLD.COM for the benefit of Registrants or for its own benefit. All operations are carried out in accordance with the regulations of the administrators of the corresponding domain zones, the requirements of ICANN and the terms of the Public Offer.
Regardless of the type of operation, from the moment the data are transmitted to the registry of the corresponding domain zone the Service is deemed provided and is irreversible; the funds for it are not refunded in accordance with the Refund Policy.
The registration of a new domain name is initiated by the Partner through the account/interface after payment for the corresponding Service from the Balance. The domain name must be available and comply with the rules of the corresponding domain zone. The Partner ensures the completeness and accuracy of the Registrant’s data transmitted to the registry and is responsible for ensuring that the registration does not infringe the rights of third parties. The Registrar performs the necessary actions no later than one business day after the cost of the Service is debited; the actual moment of registration depends on the registry’s regulations. After the data are transmitted to the registry, the Service is deemed provided.
Renewal is carried out throughout the entire registration period through the account/interface; the Registrar performs it no later than one business day after the cost of the Service is debited. After the period expires, a grace period applies in accordance with the regulations of the corresponding zone, after which the domain name is deleted and may become available for registration by third parties. The Partner is solely responsible for the timely renewal of its Registrants’ domain names and for notifying Registrants of the approaching expiry of the period. The billing system may send the Partner service notifications about the approaching expiry of the period.
The transfer of a domain name to the maintenance of another registrar is carried out upon application in the manner set out in the «Procedure for Submitting Applications» section of the Public Offer, indicating the domain name and the identifier of the receiving registrar. The Partner obtains from the current Registrant and provides to the Registrar the documents and confirmations of the Registrant’s will necessary for the transfer; the Registrar commences performance only after a complete and duly executed set is received. A transfer is not possible, in particular, if: 60 days have not elapsed since the registration or the previous transfer; less than 15 days remain until the expiry of the registration period; the Registrant’s contact details were changed less than 60 days ago; the domain name is the subject of a dispute; a status prohibiting transfer is set; the Partner has a debt; the domain is in a grace or redemption period.
A change of Registrant — the transfer of the right to administer a domain name to another Registrant — is carried out: (A) between accounts in the UATLD.COM system — through the account/interface; (B) in other cases — on the basis of a written application of the current Registrant of the domain name. Operations relating to re-delegation are performed solely on the basis of the will of the current Registrant; the Partner does not impede the Registrant’s wish to change registrar in accordance with the agreement between the Partner and the Registrant.
A domain name serviced through the account of one Partner may be transferred to the maintenance of the account of another Partner within the Registrar’s systems (UATLD.COM) without a change of Registrant (owner) and without cancelling the delegation. Such transfer concerns only which Partner services the domain name and is not a change of Registrant or a transfer to another registrar.
The transfer is carried out on the basis of the will of the Registrant (owner) of the domain name — confirmed by an authorisation code, an application or another means provided for in the account — with the consent of the receiving Partner. The transfer is possible under the following conditions: the receiving Partner has an active (not suspended) account; there is no unresolved dispute and no restrictions prohibiting the corresponding operation in respect of the domain name; there is no debt blocking the operation. The Registrar has the right to take additional measures to establish the authenticity of the Registrant’s will and to request supporting documents.
From the moment of transfer, the receiving Partner bears all obligations regarding the servicing of the corresponding Registrant, including concluding its own agreement with it and ensuring consents in accordance with the «Mandatory Requirements for the Partner’s Agreement with Registrants». The paid delegation period is retained for the domain name; no recalculation or refund of funds is made in connection with the transfer. The Registrar may provide for a fee in the account for the transfer operation. The mass transfer of domain names between Partners (in particular in the event of a business transfer) is carried out by a separate arrangement with the Registrar.
The transfer of maintenance between Partners without the participation of the Registrant is possible only as a technical consequence of the termination of servicing by a Partner (the «Term. Amendment and Termination» section of the Public Offer) — to ensure the uninterrupted functioning of domain names, with subsequent notification of the Registrants of their right to choose another Partner or registrar.
A domain name may be deleted early at the initiative of the Partner or as a result of non-renewal. After deletion, within the redemption period of the corresponding zone, restoration of the registration is possible as a separate paid Service. Early deletion is not grounds for a refund.
The Partner ensures the accuracy, truthfulness and timely updating of the information about Registrants and other contacts of domain names that is transmitted to the registry. The Registrar has the right to take additional measures to establish the authenticity of applications and to request supporting documents; the requested documents are provided within 5 business days.
